Terms & Conditions

Last updated: September 2026

1. Introduction

Welcome to EverBrook Publishing ("EverBrook Publishing," "we," "us," or "our"). These Terms & Conditions govern your use of our website and your purchase or use of our services.

By accessing our website, contacting us about our services, placing an order, or otherwise engaging our services, you agree to be bound by these Terms & Conditions. If you do not agree with these terms, please do not use our website or services.

2. Our Services

EverBrook Publishing provides professional publishing and digital services, which may include:

  • eBook, paperback, and hardcover book formatting.
  • EPUB and digital book conversion and formatting.
  • Book cover design and related design services.
  • Book editing and proofreading services where specifically agreed.
  • Publishing and distribution support.
  • Amazon KDP, IngramSpark, Lulu, Draft2Digital, and related publishing support.
  • Website development and related web services.
  • Other publishing, design, development, or technical services agreed with the client.

The exact services included in an order will depend on the quotation, proposal, package, custom order, invoice, or other written agreement between EverBrook Publishing and the client.

3. Orders and Project Scope

Before work begins, the client is responsible for providing accurate project requirements and all necessary files and information.

An order is considered accepted when the scope of work, price, and other relevant requirements have been agreed upon and the required payment or deposit has been received, where applicable.

Work requested outside the original agreed scope may require an additional fee and may result in an updated delivery timeline.

4. Client Responsibilities

Clients are responsible for providing accurate, complete, and usable materials required for their project.

This may include manuscripts, images, logos, ISBN information, metadata, author information, publishing details, and other relevant materials.

Clients are also responsible for ensuring that they have the necessary rights, licenses, and permissions to use any content, images, fonts, trademarks, or other materials supplied to EverBrook Publishing.

EverBrook Publishing is not responsible for legal claims resulting from copyrighted, trademarked, unauthorized, illegal, or otherwise infringing materials supplied by a client.

5. Manuscripts and Client Materials

Clients retain ownership of the original manuscripts, documents, images, and other materials they provide to us, subject to any separate agreement between the parties.

By providing materials to EverBrook Publishing, the client grants us permission to use those materials as reasonably necessary to perform the requested services.

We will not intentionally sell or distribute a client's manuscript or other confidential project materials for unrelated commercial purposes.

6. Payments

Clients agree to pay the fees specified in the applicable quotation, package, custom order, invoice, or other agreed arrangement.

Depending on the project, EverBrook Publishing may require full payment in advance, a deposit before work begins, or payment according to an agreed milestone schedule.

Work may be paused or withheld where an agreed payment remains outstanding.

Any applicable transaction, payment processing, currency conversion, or third-party fees will be handled according to the agreed payment arrangement.

7. Revisions and Corrections

Revisions included with a service will be limited to the scope and number of revisions agreed at the time of purchase.

Corrections resulting from an error made by EverBrook Publishing within the agreed scope will be addressed appropriately.

Changes resulting from new instructions, rewritten manuscript content, replacement images, changes in design direction, or requirements introduced after approval may be treated as additional work and may incur additional charges.

8. Project Timelines and Delivery

We will make reasonable efforts to complete projects within the agreed timeframe. Delivery times may vary depending on project complexity, client responsiveness, revisions, and the availability of required materials.

Delays caused by incomplete information, late responses, additional revisions, third-party platforms, technical problems, or circumstances outside our reasonable control may affect the original delivery timeline.

9. Client Review and Approval

Clients are responsible for reviewing proofs, previews, and final files before approving a project for publication, printing, distribution, or public release.

Clients should carefully verify the final text, formatting, images, page numbers, metadata, ISBN information, links, and other project details before final approval.

Once a client approves final files, additional changes may require a new order or additional charges.

10. Third-Party Publishing Platforms

EverBrook Publishing may assist clients with third-party platforms such as Amazon KDP, IngramSpark, Lulu, Draft2Digital, and other publishing or distribution services.

These platforms are independently operated by third parties and are subject to their own terms, requirements, policies, review processes, fees, and technical systems.

While we make reasonable efforts to prepare files according to the requirements provided by the relevant platform, we do not guarantee that a third-party platform will approve, publish, distribute, list, print, or sell a book.

Any rejection, delay, account restriction, policy decision, printing issue, distribution limitation, or other action taken by a third-party platform is outside EverBrook Publishing's direct control.

11. Copyright and Intellectual Property

Clients remain responsible for the legality and ownership of the content they provide to EverBrook Publishing.

Unless otherwise agreed in writing, EverBrook Publishing does not claim ownership of a client's original manuscript or other original content simply because that material has been submitted to us for a service.

Rights relating to designs, templates, source files, layouts, code, graphics, or other work created by EverBrook Publishing will be governed by the specific agreement or order for that project.

12. Portfolio and Promotional Use

We may wish to showcase completed work as part of our professional portfolio or marketing materials.

Where a project contains confidential, unpublished, or sensitive client material, we will respect any confidentiality arrangement agreed with the client.

13. Website Use

You agree to use our website lawfully and responsibly.

You must not use the website to distribute malicious software, attempt unauthorized access, interfere with website operations, submit unlawful content, impersonate another person, or otherwise misuse our services or systems.

14. Website and Service Availability

We make reasonable efforts to keep our website and services available, but we do not guarantee that the website or any particular service will always be available, uninterrupted, secure, or free from errors.

15. Limitation of Liability

To the extent permitted by applicable law, EverBrook Publishing will not be responsible for indirect, incidental, special, or consequential losses arising from the use of our website or services.

We are also not responsible for losses resulting from third-party platforms, services, publishing accounts, distribution services, payment processors, hosting providers, or other services outside our direct control.

16. Events Outside Our Control

We will not be considered responsible for delays or failures caused by circumstances reasonably outside our control, including major technical failures, internet outages, natural disasters, government actions, platform outages, or other unforeseen events.

17. Cancellation or Termination

Either party may request cancellation of a project subject to the applicable Refund & Cancellation Policy and any specific agreement made for that project.

If a project is cancelled after work has started, fees may be retained or charged in proportion to the work already completed and expenses reasonably incurred.

18. Privacy

Our collection and use of personal information is described in our Privacy Policy.

19. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes in our services, business practices, or applicable requirements.

Updated terms will be posted on this page with a revised "Last updated" date.

20. Governing Law

These Terms & Conditions shall be interpreted and applied in accordance with applicable laws and regulations. Any disputes will be addressed through good-faith communication first and, where necessary, through the appropriate legal process.
